PURPOSE:

Under the general direction of the Associate Vice President of Community and Belonging, the Civil Rights and Title IX Director provides leadership and direction for the CSU Monterey Bay Office of Civil Rights and Title IX. The Director is a hands-on administrator responsible for developing, implementing, monitoring, and coordinating the campus’ Civil Rights/Title IX program.  The University’s Civil Rights and Title IX Director is responsible for university compliance with Title IX of the Education Amendments of the 1972 Civil Rights Act, the Violence Against Women Act (VAWA), Title VI of the Civil Rights Act of 1964, Clery, and CSU systemwide and University policies prohibiting discrimination, harassment, and retaliation. 

Consistent with CSU Chancellor’s Office expectations for Civil Rights and Title IX leadership, this position requires a regular and visible on-campus presence. The Director conducts sensitive intake and case-related meetings, responds to time-sensitive matters, coordinates with campus partners and law enforcement, provides training and outreach, and maintains trust across the campus community.

ESSENTIAL DUTIES AND RESPONSIBILITIES include, but are not limited to, the following:

  1. Serves as the University’s Title IX Coordinator and Discrimination, Harassment and Retaliation (DHR) Prevention Administrator, in accordance with CSU Executive Orders 1096 and 1097 (and subsequent iterations when revised), which includes oversight of and/or investigating allegations of discrimination, harassment, retaliation and sexual violence; meeting with or communicating with complainants and respondents on a regular basis to determine what supportive measures are necessary or appropriate and ensuring that such measures are implemented; developing and/or overseeing educational and primary prevention programs and training materials relating to sexual harassment and sexual violence; regularly assessing student activities and campus wide events to ensure that the practices and behaviors do not violate policies against sexual harassment and violence or other discrimination or harassment; preparing annual statistical reports in compliance with Chancellor Office mandates; and monitoring and overseeing campus implementation of Title IX and DHR compliance. Serves as the University’s central resource on issues related to sexual violence, sexual and gender-based harassment, domestic and dating violence, stalking and retaliation, ensuring a fair and neutral process for all parties. As part of campus oversight of Civil Rights and Title IX compliance, the Director will participate in the campus Behavioral Intervention Team (BIT) to ensure real-time information processing.
  2. Oversees and conducts investigation of complaints alleging violations of University policies prohibiting discrimination, harassment and retaliation; conducts fact-finding including interviewing the complainant, respondent and potential witnesses, assessing the credibility of witnesses, drawing conclusions, preparing detailed written investigatory reports and making recommendations for action; assesses whether interim remedies are necessary for complainant, pending completion of investigation; uses sound investigative techniques to encourage engagement, interpret policies, analyze situations and logically come to conclusion of preponderance of evidence; engages in Informal Resolution processes as outlined in and consistent with the CSU Nondiscrimination Policy; utilizes outstanding organizational skills to ensure well documented, up-to-date and completed case files; and provides advice and guidance as needed to conclude complaints. Oversees other campus investigators and facilitates the utilization of outside investigators when appropriate.
  3. Works in coordination with other appropriate offices to facilitate or conduct conflict resolution for campus affiliates.  Recognizing that not all individuals wish to pursue investigation, or some matters may not fall distinctly within a specific established policy, the Director is responsible for collaborating efforts to provide conflict resolution support where appropriate, ensuring proper coordination with Human Resources, Ombuds, Academic and/or Student Affairs, and any other pertinent office.
  4. Coordinates and monitors Title IX efforts of other delegates and university offices that receive and/or investigate complaints, including but not limited to Human Resources, Student Conduct, and Campus Police. Works collaboratively with Academic Affairs/Academic Personnel, University Corporation, Human Resources, and the Office of Community and Belonging as needed. Implements and recommends relevant campus policies related to areas of responsibility. 
  5. Oversees, develops, and provides education, training, and outreach programming to campus community including but not limited to prevention and reporting of sexual violence, sexual and gender-based harassment, domestic and dating violence, stalking and retaliation. Presents educational programs on nondiscrimination and harassment prevention and oversees campus compliance with AB 1825.  Monitors and oversees campus implementation of the California Whistleblower Act.  Provides or recommends training to responsible employees, investigators, and other campus officials with Title IX responsibilities.
  6. In partnership with Human Resources and the Office of Community and Belonging, develops and provides education, training, and programming for campus efforts as appropriate, as well as managerial training to help retention and discrimination prevention efforts.  The Director will coordinate with Human Resources, the Office of Community and Belonging and Academic/Student Affairs as appropriate to create, partner, and/or support these efforts.
  7. Hires, trains, evaluates, and supervises staff. Develops, implements and assesses office annual strategic plan and manages office operations and budget.
  8. Keeps current with frequent changes in system-wide policies and federal and state policy changes that affect the scope of responsibilities.  Serves on committees, task forces, and advisory boards, programs and projects as assigned.
  9. Reviews all cases and assists UPD with timely warnings.

KNOWLEDGE, SKILLS AND ABILITIES:

Exceptional interpersonal communication and writing skills. Ability to gather and analyze data, conduct investigations, make witness credibility assessments, reason logically and draw valid conclusions. Demonstrated ability to develop, lead and effectively facilitate training programs. Ability to handle confidential and sensitive matters with discretion and neutrality; and oversee and resolve highly sensitive, complex and/or unprecedented problems. Commitment to serving a diverse student and employee population with cultural sensitivity. Demonstrated ability to prepare complex reports and make effective presentations. Knowledge of or ability to quickly learn CSU policies, procedures and practices. Ability to handle multiple, competing priorities in a well-organized and focused manner; quickly shift priorities without loss of continuity; establish and maintain positive and professional working relationships with a diverse population; and independently interpret, analyze, apply and explain highly complex laws, regulations, guidelines, and policies.

Demonstrated ability to exercise independent and mature judgment, maintain objectivity, and safeguard confidential and sensitive information.  Ability to develop, lead, and effectively facilitate training programs; maintain a sense of urgency in approaching responsibilities and consult appropriately with supervisor and other campus leadership when appropriate; and foster positive relationships with diverse constituencies.

Knowledge of principles, laws and regulations related to Civil Rights and non-discrimination.  Demonstrated knowledge of and ability to interpret Title IX as well as related federal, state, and local equal opportunity and non-discrimination laws and regulations.

Demonstrated ability to conduct investigations of complaints alleging discrimination, harassment, sexual harassment (including sexual violence, dating/domestic violence, and stalking) and/or retaliation, to include interviewing parties, making credibility assessments, drawing conclusions, and preparing detailed written reports. Sensitivity to and thorough understanding of the impact of trauma on individuals and the impacts on process access and cognitive ability; demonstrated knowledge of trauma-informed practices in Title IX/civil rights processes, including investigations and hearings.

MINIMUM QUALIFICATIONS:

A master’s degree in social work, psychology, higher education administration or related field from an accredited university. Minimum of five years of progressively responsible supervisory or management experience, preferably in a large public or private organization or institution of higher education, with responsibility for compliance with laws, regulations and guidelines in a comprehensive employment practices and/or affirmative action program.

PREFERRED QUALIFICATIONS:

Technical fluency with Oracle/PeopleSoft, CSU Common Management System or equivalent student information system; Microsoft Office Professional Suite, and Google mail and calendaring programs. 

Juris Doctorate strongly preferred; significant experience conducting investigations of complaints either alleging discrimination, harassment or sexual violence, including interviewing witnesses, making credibility assessments, drawing conclusions and preparing detailed, written reports.

  • This position is designated as a Campus Security Authority (CSA).  The position is required to participate in training at the direction of the Clery Director and must also promptly report allegations of reportable crimes according to the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, its accompanying regulations; the California State Education Code, Chapter 15.5, of the Donahoe Higher Education Act, Section 67380; and the California State University system-wide policy, Code EO 1107.
  • This position has been designated as a sensitive position with responsibility for:
    • the care, safety and security of people (including children and minors), animals and CSU property
    • access to and responsibility for detailed personally identifiable Level 1 confidential information about students, faculty, staff or alumni that is protected, personal or sensitive as defined in the CSU Information Security Data Classification Standards).

PHYSICAL ENVIRONMENT:

Office environment with standard equipment and tasks. The position requires working at a computer and desk for extended periods of time.  May require travel between campus offices and off-campus locations.
