Job Summary

Under the general direction of the Executive Director of Institutional Equity & Compliance, the Associate Director of Institutional Equity & Compliance assists with compliance with CSU policies encompassing Title IX, Discrimination/Harassment/Retaliation (DHR), Whistleblower reports, and the Americans with Disabilities Act (ADA). The Associate Director performs trauma informed intake meetings, oversees Formal and Alternative Resolutions, and in particular the management of timely, high quality, fair, and thorough investigations. Supervises (and ensures attention to the professional development of) a team of investigators. The incumbent independently performs complex investigations and reviews, analyzes, and evaluates investigative plans, investigative reports, and other documents for accuracy, completeness, quality, and consistency with applicable law and University policy in collaboration with the Executive Director.

Responsibilities

• Conduct intake meetings with parties to explain available resources, supports, and resolution options. Provide clear guidance on filing a formal complaint, pursuing formal or informal resolution, and accessing supportive measures with or without filing a formal complaint.
• Facilitate notices of investigation, no-contact orders, and ensure appropriate administrative holds are placed.
• Coordinate interim measures, accommodations, and responses with campus partners including faculty, the University Police Department, Student Affairs, and Housing and off-campus resources.
• Conduct prompt, equitable, and impartial investigations into complaints under the CSU Nondiscrimination Policy, Whistleblower Policy (EO 1115) and Whistleblower Retaliation Policy (EO 1116). Responsibilities include identifying and interviewing involved parties, gathering and assessing relevant information, applying applicable policies, and making findings of fact in individual cases.
• Maintains current knowledge of existing and pending legislation, law, and trends related to the field. Ensures investigatory methods, processes, and procedures reflect and comply with the most current standards and regulations, as well as best practices in the field. Reviews and assesses departmental operations and services with respect to Formal and Alternative resolutions for effectiveness and efficiency and recommends changes as needed to improve operations and delivery of services. Reads pertinent literature, attends meetings, and participates in professional associations as appropriate. Establishes and maintains an active network of campus partners and professional contacts. Serves as a subject matter expert on the CSU Nondiscrimination Policy.
• This role may be required to provide testimony regarding cases to outside agencies, provide advice and guidance to campus constituents, and interact with the CSU Office of the Chancellor, General Counsel, Civil Rights Attorney, Systemwide Director, Administrators, and colleagues at campuses within the CSU System.

Supervise and Guide Investigators:
• Oversee the work of internal and external investigators, ensuring adherence to applicable laws, policies, and procedures. Provide guidance, set deadlines, and ensure comprehensive documentation of all resolution processes.
• Assigns and supervises the timely implementation of Formal and Alternative Resolutions of Formal Complaints evaluates investigative plans, investigative reports, and other documents for accuracy, completeness, quality, and consistency with applicable law and University policy
• Responsible for their training and professional development, including the establishment of performance goals; conducting performance appraisals, as well as providing periodic, timely feedback

Campus Outreach and Training
• Conducts training, outreach, and other educational programs and services independently and/or in conjunction with other Title IX / DHR team members to ensure faculty, staff, students, and other community members fully understand and are well-informed regarding University policy and Title IX / DHR resolution options, including any changes or updates. Assists with the creation of office materials that help to communicate IEC’s mission and clarify the various resolution options. Identifies training needs for faculty, staff, and students as reflected by issues, situations, or complaint trends. Makes training recommendations for parties and other campus community members, as necessary and appropriate. Creates and maintains partnerships with campus stakeholders, including faculty, staff, students and other offices and units whose work intersects with that of the IEC Office
• Coordinates with the Employee Labor and Relations and Faculty Affairs Provost Office on matters pertaining to staff and faculty, accordingly.
• Works closely with Student Conduct Administrator on Title IX/DHR matters resulting in student discipline.
• Assists in the preparation and dissemination of educational materials, including brochures, posters, and web-based materials, to inform members of the campus community of Title IX/DHR rights and responsibilities.

Minimum Qualifications: Required Education and Experience

• Equivalent to a Master’s Degree in a related field or Juris Doctorate and three years of related experience required.
• Investigations, regulatory compliance and supervisory experience preferred.

Required Qualifications

Knowledge of federal and state equal employment, disability, and family medical leave law and regulations, including Title V, Title II, Title VII, Title IX, and Sections 503, 504, and 508 of the Rehabilitation Act; all pertinent sections of the Americans Disabilities Act; and federally mandated affirmative action plans under the US Department of Labor, Office of Federal Contract and Compliance Programs.

Preferred Qualifications

• Experience working in higher education or regulatory compliance preferred.
• J.D. or other related master’s degree preferred.
• Profession Certifications: ATIXA Title IX Coordinator, NACUA Title IX Coordinator, Certified Fraud Examiner (CFE), or Association of Workplace Investigators Certificate Holder (AWI-CH)

Compensation and Benefits:

Anticipated Hiring Range: $8,333 - $10,000 per month. 

The salary offered will take into account internal equity and experience among other factors.

Position Information:

Work status: Full-time/Exempt/At-will

Academic year schedule: Monday through Friday (8:00 am – 5:00 pm), some evenings/weekends.

Summer schedule: Monday through Thursday (7:00 am - 5:30 pm), some evenings/weekends.          

This is a full-time management (MPP) position.  MPP employees serve at the pleasure of the campus President.  MPPs do not serve a probationary period and never receive permanent status.

This position is a "designated position" in the California State University's Conflict of Interest Code. The scope of responsibilities for this position includes making or participating in decisions that may have a material financial benefit to the incumbent. Therefore, the individual holding this position is required to file an initial Conflict of Interest: Statement of Economic Interests ("Form 700") within thirty (30 days) from the date of hire and on an annual basis. In addition, the individual holding this position must complete the required conflict of interest training within thirty (30) days of their appointment and at least once during each consecutive period of two calendar years following the appointment, subject to the Fair Political Practices Commission regulations.

First considerations will be given to candidates who apply by Friday, March 28, 2025 and will continue until the position is filled; however, the position may close when an adequate number of qualified applications are received.

Background Check

Satisfactory completion of a background check (including a criminal records check) is required for employment.  CSU will make a conditional offer of employment, which may be rescinded if the background check reveals disqualifying information, and/or it is discovered that the candidate knowingly withheld or falsified information.  Failure to satisfactorily complete the background check may affect the continued employment of a current CSU employee who was conditionally offered the position.

Drivers License Check

Possession of a valid Driver's License is required.  Employees in this position will be enrolled in the Department of Motor Vehicles (DMV) Government Employer Pull Notice Program which confirms possession of a valid driver's license and reflects driving record.

Mandated Reporter

The person holding this position is considered a `mandated reporter' under the California Child Abuse and Neglect Reporting Act and is required to comply with the requirements set forth in CSU Executive Order 1083 as a condition of employment.

Campus Security Authority

This position is designated as a Campus Security Authority (CSA) position under the federal Jeanne Cleary Disclosure of Campus Security Policy and Campus Crime Statistics Act. CSAs are responsible for reporting allegations of Clery Act Crimes reported to them or that they witness. CSA training is required.
